Your use of this website and any service contained within constitutes acceptance of these Terms & Conditions.

Customer Information

You should always check that the contact information you provide is correct before creating a customer account or proceeding to payment.

You are responsible for maintaining your own username and password and should ensure that you store these securely and do not pass them on to any third party.

You are responsible for your customer account and actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately.

Our website is only intended for use by adults. Adults may purchase products for children as long as the products purchased are intended by the manufacturer for use or consumption by children.

Privacy

Mount Whittle is registered under and complies with the Data Protection Act 1998.

Mount Whittle Seats takes your privacy seriously and are committed to protecting the privacy of users of this website and the confidentiality of the information provided by users of this website.

We reserve the right to gather information relating to use of the website. By using the website you consent to collection and use of this information by Mount Whittle Seats and by creating an account you consent to Mount Whittle Seats contacting you to provide you with marketing and delivery information.

Your personal data will be handled in accordance with Mount Whittle Seats Data Protection and Privacy Policy which can be viewed here.

Price Policy

Mount Whittle Seats makes every effort to ensure that the pricing displayed on this website is correct. However, if an error in the pricing of a product is found, we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable).

The processing of an order can be cancelled or corrected by Mount Whittle Seats at anytime up to the shipment of that order and any related items.

We reserve the right to adjust the VAT element if this changes from 15%.

Mount Whittle Seats reserve the right to alter all product pricing without notice. No more than 4 chairs can be purchased by any one party without prior agreement with Mount Whittle Ltd.

Title in any products ordered from Mount Whittle Seats does not pass to you, the purchaser, until Mount Whittle Seats have received and processed a valid payment, and that payment has been made into our own bank account and your order has been shipped.

Your Order

When you place an order you will automatically receive a confirmation email. Your order constitutes an offer made to Mount Whittle Seats to purchase the goods specified in the order.

Your offer is only accepted by Mount Whittle Seats once we have dispatched your order.

Product items not included within the confirmation email are not included in the order and contract between you and Mount Whittle Seats.

We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.

If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account.

Shipping

All orders are shipped subject to availability. Our aim being to deliver all products within 15 working days.

We normally only accept orders from customers residing in the UK and Eire.

We reserve the right to ship products at a later date (up to 30 days after purchase) where product components are not in stock at the time of purchase. In this situation you will be contacted and offered the option of a full refund instead of delivery of the product.

Mount Whittle Seats cannot be held responsible for disruption to shipping caused by industrial disputes or action outside our direct control. If such disruption occurs you will be offered delivery via an alternative delivery or fulfilment company or a full refund.

Cancellation Rights, Returns and Refunds

Under the Consumer Protection (Distance Selling) Regulations you have a statutory right to cancel your order and receive a full refund, apart from items personalised for you. You may cancel your order up to and including the seventh day after receipt.

Notice of cancellation must be in writing, a telephone call is not a valid cancellation.

Your purchase must be returned to Mount Whittle Seats at your expense and should be packaged in such a way as to avoid damage in transit. Ideally you should use the packaging and carrier that delivered your purchase to you.

No right of cancellation, refund or return exists under the Consumer Protection (Distance Selling) Regulations 2000 once you have used your product, unless the product is defective and you are returning it for this reason. For clarity if the chair has been assembled then you will have deemed to have used the product.

Please observe the following procedure for all returns to Mount Whittle Seats:

1. Please include a note with your details, eg chair type, name, address etc and the reason for the return.
2. If you are returning your product because it is defective or damaged, please state clearly the nature of the defect or damage.
3. Repackage the product in its original packaging, including any accessories, brochures, manuals, guarantees or warranties that came with the product. Unfortunately we will be unable to issue a refund where the product is in an incomplete state.
4. If you are returning the seats because of damage in transit or there is a defect please contact us to advise of the damage or defect and also to advise us whether a replacement or refund is required.
5. If the original packaging has been damaged or destroyed - or you have assembled the seat such that the packaging can no longer be used – then we will provide packaging for return. If the existing packaging is useable then this should be used to return the seat. In all cases the seat should be returned using the same carrier that delivered the product in the first instance and we will make the necessary arrangements.

Mount Whittle Seats will not issue refunds for any items lost or stolen in transit to Mount Whittle Seats. Where a return is lost or stolen in transit to Mount Whittle Seats, you should claim compensation from the company that shipped the return.

If you fail to return a product to Mount Whittle Seats, we may make arrangements to have the product collected from you. The cost of this collection will be passed on to you.

Unused defective products may be returned promptly by customers to the address shown below.

Subject to the above, we will refund the purchase price of a returned product within thirty days of receiving written notification of your intention to return the product and the date of receipt of the defective product whichever is the later date.

Complaints

Mount Whittle Seats endeavour to respond to all customer complaints or queries within five working days.

Faulty Products

Where a Customer experiences a fault with a product it can be returned to Mount Whittle Seats, subject to our returns policy above.

Events Outside Our Control

Mount Whittle Seats shall not be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to, acts of god, war, civil disorder or industrial dispute.

Price and VAT

If the rate of value added tax (VAT) increases between the date of your order and the date of delivery Mount Whittle Seats will add the necessary additional amount of value added tax to the price of the goods.

Exclusions

We shall not be liable for any direct loss or damage suffered by you howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise in excess of £1,000

Mount Whittle Seats shall not under any circumstances be liable for any indirect or consequential loss howsoever caused whether by negligence, breach of contract, misrepresentation or otherwise.

Mount Whittle Seats or our insurers shall not be liable or investigate any claim for loss unless you have given Mount Whittle Seats written notice within 21 days of its occurrence and given Mount Whittle Seats or our insurers every facility to investigate such occurrence.
